AGREEMENT TO OUR LEGAL TERMS

Welcome to Sabah Car Rental. These Terms of Service (“Terms”) govern the rental and use of vehicles booked through our website and services. By making a booking, renting a vehicle, or using our services, you acknowledge that you have read, understood and agreed to these Terms.

Please read them carefully before making a reservation.

1. Rental Eligibility

To rent a vehicle from Sabah Car Rental, customers must:

  • Meet the minimum age requirement of [e.g. 21 years old].

  • Hold a valid driving licence appropriate for the vehicle being rented.

  • Provide a valid identification document, such as an identity card or passport.

  • Provide any additional documents reasonably required by Sabah Car Rental.

  • Provide accurate and complete information when making a booking.

Additional requirements may apply depending on the vehicle type, rental period, driver’s age, nationality or other circumstances.

Sabah Car Rental reserves the right to refuse a rental where the customer does not meet the required eligibility criteria.

2. Booking and Reservation

A booking request submitted through our website does not automatically guarantee vehicle availability.

A reservation is considered confirmed only after Sabah Car Rental has confirmed the booking and where applicable, received the required payment or deposit.

Customers are responsible for ensuring that all booking information, including their name, contact details, rental dates, pickup location, return location and selected vehicle, is accurate.

If the requested vehicle is unavailable, Sabah Car Rental may offer a similar or alternative vehicle, subject to availability and customer agreement.

3. Rental Period

The rental period begins at the agreed pickup time and ends when the vehicle is returned to the agreed location and accepted by Sabah Car Rental.

Customers are required to return the vehicle on or before the agreed return date and time.

Any request to extend the rental period must be made in advance and is subject to vehicle availability and approval by Sabah Car Rental. Additional rental charges may apply.

Customers must not retain or continue using the vehicle beyond the agreed rental period without prior approval.

4. Rental Charges and Payment

The rental price will be based on the vehicle, rental period, and applicable rates displayed or quoted at the time of booking.

Additional charges may apply for services or circumstances including, but not limited to:

  • Additional rental days or hours

  • Delivery or collection outside the agreed location

  • Additional drivers

  • Excessive cleaning

  • Fuel shortages

  • Damage to the vehicle

  • Loss of vehicle accessories or equipment

  • Traffic, parking, or other legal penalties

  • Late return fees

  • Other charges stated at the time of booking

Payment methods accepted by Sabah Car Rental may include [credit/debit card, online banking, cash, etc.].

5. Security Deposit

A security deposit of RM500–RM1,000 (depending on vehicle) is required before the vehicle is released to the customer.

The deposit may be used to cover outstanding charges, damage, loss, excessive cleaning, missing items, traffic or parking penalties or other costs arising from the customer’s use of the vehicle.

Subject to inspection and settlement of all applicable charges, the remaining deposit will be returned according to Sabah Car Rental’s applicable refund procedure.

6. Vehicle Condition

The vehicle will be provided in a reasonably clean and roadworthy condition.

Customers are encouraged to inspect the vehicle before accepting it and to report any existing damage, defects or missing items to Sabah Car Rental before driving away.

Customers may be responsible for damage that was not previously recorded and occurs during their rental period, subject to the applicable rental agreement and insurance coverage.

Customers must not make repairs, modifications or alterations to the vehicle without prior approval from Sabah Car Rental, except where immediate action is reasonably necessary for safety.

7. Use of the Vehicle

The rental vehicle must be used responsibly and in accordance with Malaysian laws and regulations.

Customers must not:

  • Use the vehicle for illegal activities.

  • Use the vehicle for racing, speed testing, or other dangerous driving activities.

  • Use the vehicle to transport illegal or prohibited goods.

  • Allow an unauthorised person to drive the vehicle.

  • Use the vehicle for commercial purposes, ride-hailing, delivery services, or other purposes not agreed upon with Sabah Car Rental.

  • Drive the vehicle while under the influence of alcohol, drugs or any substance that may impair driving ability.

  • Intentionally or negligently cause damage to the vehicle.

  • Take the vehicle outside the agreed geographical area without prior permission.

  • Sub-rent or transfer the vehicle to another person.

Any violation of these requirements may result in termination of the rental and additional charges.

8. Additional Drivers

Only drivers who have been authorised by Sabah Car Rental may operate the rental vehicle.

Additional drivers must meet the applicable age, licence and documentation requirements and may be subject to an additional fee.

The primary renter remains responsible for the vehicle and for ensuring that any authorised driver complies with these Terms.

9. Fuel

The vehicle will be provided with full tank fuel.

Customers are expected to return the vehicle with the same fuel level. Please return the car with a full tank to avoid a RM50 refuelling surcharge.

If the vehicle is returned with less fuel than the agreed level, Sabah Car Rental may charge the applicable refuelling cost and service fee.

10. Mileage

Mileage restrictions include 300 km per day.

Where a mileage limit applies, the applicable limit and additional mileage charges will be communicated to the customer before or at the time of booking.

11. Pickup and Return

Customers must collect and return the vehicle at the agreed date, time and location.

Customers should allow sufficient time for vehicle inspection and handover.

If a customer expects to be delayed, they should contact Sabah Car Rental as soon as possible.

Additional fees may apply for late returns, out-of-hours collection or return or changes to the agreed pickup or return location.

12. Late Returns

Vehicles returned after the agreed return time may be subject to additional charges.

Where a late return significantly affects another customer’s reservation, Sabah Car Rental may also charge reasonable costs arising from the delay.

Customers who require additional rental time should contact Sabah Car Rental before the original return time.

13. Cancellation and Changes

Customers who wish to cancel or change a booking should contact Sabah Car Rental as soon as possible.

Cancellation fees and refund eligibility may depend on how far in advance the cancellation is made and whether any payment or deposit has already been made.

The applicable cancellation policy will be communicated during the booking process or included in the customer’s booking confirmation.

Sabah Car Rental reserves the right to establish different cancellation policies for special periods, promotions, peak seasons, or specific vehicle categories.

14. Accidents, Damage and Breakdown

In the event of an accident, breakdown, theft, or other emergency involving the rental vehicle, customers must contact Sabah Car Rental as soon as reasonably possible.

Customers must:

  1. Stop the vehicle safely where possible.

  2. Contact the relevant authorities or emergency services where necessary.

  3. Exchange information with other parties involved in an accident where legally required.

  4. Notify Sabah Car Rental promptly.

  5. Cooperate with any insurance, police, or investigation procedures.

  6. Not admit liability or make arrangements for repairs or compensation without consulting Sabah Car Rental, except where required by law or necessary for immediate safety.

Customers must not abandon the vehicle without prior instruction from Sabah Car Rental or the relevant authorities.

Any liability for damage will be determined according to the applicable rental agreement, insurance coverage, and circumstances of the incident.

15. Insurance and Liability

Rental vehicles may be covered by insurance subject to the applicable policy terms, exclusions, excess, and conditions.

Insurance coverage does not necessarily cover all types of damage or loss.

The customer may be responsible for costs resulting from circumstances excluded from the applicable insurance policy, including but not limited to:

  • Reckless or negligent driving

  • Driving under the influence of alcohol or drugs

  • Unauthorised drivers

  • Unauthorised use of the vehicle

  • Damage caused by prohibited use

  • Damage caused by intentional acts

  • Failure to comply with applicable rental or insurance requirements

The specific insurance coverage and applicable excess will be communicated to the customer where relevant.

16. Traffic, Parking and Other Fines

Customers are responsible for all traffic offences, parking fines, toll charges, summonses, penalties, and other charges incurred during their rental period as a result of their use of the vehicle.

Where Sabah Car Rental receives a fine, notice, or charge relating to the customer’s rental period, the customer may be responsible for the relevant amount and any reasonable administrative costs associated with processing it.

17. Vehicle Cleanliness

Customers are expected to return the vehicle in a reasonably clean condition.

Additional cleaning charges may apply if the vehicle requires excessive cleaning due to circumstances such as:

  • Food or drink spills

  • Stains

  • Mud or excessive dirt

  • Smoke or cigarette odour

  • Pet hair

  • Other unreasonable contamination

Smoking or vaping inside the vehicle is [prohibited / subject to a cleaning fee].

18. Loss of Personal Belongings

Customers are responsible for their own belongings during the rental period.

Sabah Car Rental is not responsible for personal items that are lost, stolen, damaged, or left inside the vehicle.

Customers should check the vehicle carefully before returning it.

19. Geographic Restrictions

Rental vehicles may only be driven within areas approved by Sabah Car Rental.

Travel to certain areas, states, islands, border areas, or other destinations may require prior approval.

Customers must not take the vehicle outside Sabah or across international borders without written permission from Sabah Car Rental.

20. Right to Terminate a Rental

Sabah Car Rental may terminate a rental agreement or request the immediate return of a vehicle where:

  • The customer breaches these Terms.

  • The vehicle is being used illegally or dangerously.

  • The customer provides false or misleading information.

  • The customer fails to make required payments.

  • The vehicle is being used by an unauthorised driver.

  • Continued use of the vehicle may create a safety, legal, financial, or operational risk.

Where a rental is terminated due to the customer’s breach, the customer may remain responsible for applicable charges, costs, damage, or losses.

21. Website Information

Sabah Car Rental makes reasonable efforts to ensure that information displayed on the website is accurate and up to date.

However, vehicle availability, prices, specifications, images, and other information may change without prior notice.

Vehicle images shown on the website may be for illustration purposes and may not always represent the exact vehicle supplied.

22. Privacy

Personal information collected during the booking and rental process will be handled in accordance with our Privacy Policy.

Customers are responsible for ensuring that the information they provide is accurate and up to date.

23. Changes to These Terms

Sabah Car Rental reserves the right to update or modify these Terms from time to time.

Any updated Terms will be published on this website with the revised “Last Updated” date.

The Terms applicable to a booking will generally be those in effect at the time the booking is confirmed, unless otherwise required by law or agreed between the parties.

24. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Malaysia.

Any dispute arising in connection with these Terms or a vehicle rental shall be subject to the applicable laws and jurisdiction of Malaysia.
